1. Who we are

2. Using our site

By using this site or placing an order you agree to these Terms. We may update them; the version in force when you order applies to that order.

3. Product & orders

We aim to ensure descriptions, images and pricing are accurate; minor variations may occur. An order is accepted when we email your order confirmation. If we cannot fulfil an order, we’ll cancel and refund promptly.

4. Pricing & payment

Prices are in AUD and include GST where applicable. Payments are processed securely by our payment provider; we do not store your full card/bank details on our servers.

5. Shipping, title & risk

Orders are dispatched via the method shown at checkout. Title passes on full payment; risk passes on delivery. We provide tracking when available.

6. Returns & Australian Consumer Law (ACL)

Your rights under the ACL apply in addition to any manufacturer’s warranty below.
For a major failure you can choose a refund or replacement.
For a minor failure we will repair or replace within a reasonable time.
To start a claim, email warranty@trafficwave.com.au with your order number and details.

7. Manufacturer’s one-year limited warranty (TrafficWave)

We warrant that TrafficWave is free from defects in materials and workmanship under normal use and service for one (1) year from the date of original purchase. This warranty applies to consumers and authorised retailers only.
How to obtain service
Email warranty@trafficwave.com.au for assistance. Please include proof of purchase and the model number.
What’s not covered (summary of exclusions from the printed warranty):
Damage from misuse, abuse, accident or improper installation.
Attachment of unauthorised accessories; unauthorised repairs or modifications.
Improper power supply; expired batteries; dropped product; malfunction or damage due to operating the product outside manufacturer’s recommended maintenance.
Environmental conditions, theft, neglect, or vandalism.
Loss of use while the product is at a repair facility or awaiting parts.
Products opened, used, repaired, repackaged or resealed, including (without limitation) items sold via internet auction sites or surplus/bulk resellers.
Products altered, modified or repaired without our prior express written consent.
Use outside the country/region where TrafficWave compliance has been approved, or modifications to make it operate in another country.
Remedy under this warranty
At our option, we will repair or replace defective parts that are found to be defective within the warranty period. If identical parts are not available, we may substitute compatible parts. Refunds are not offered under this manufacturer’s warranty.
This manufacturer’s warranty is the sole and exclusive warranty for the product and is in addition to your rights under the Australian Consumer Law, which cannot be excluded. To the extent permitted by law, we exclude liability for incidental, consequential or special damages. Your statutory rights may vary by state/territory.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss. Nothing in these Terms limits the consumer guarantees under the ACL.

9. Intellectual property

All site content, trademarks and materials are owned by or licensed to us. You must not copy, modify or distribute without permission.

10. Acceptable Use

You must not misuse the site. That includes trying to access data or systems you’re not authorised to access, introducing malware, scraping at scale, interfering with normal operation, or using the site to send unsolicited or unlawful communications. We may suspend or restrict access if we reasonably believe this clause is breached. If you think you’ve found a security issue, email support@trafficwave.com.au

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the NSW courts.
